Terms of Service

1. Acceptance of Terms

By accessing or using Makeba ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Makeba is operated by Makeba Ltd and provides AI-generated audio lessons for educational purposes.

2. Description of Service

Makeba is an AI-powered platform that generates audio lessons on user-submitted topics. The Service includes:

  • AI-generated curriculum and lesson scripts
  • AI-narrated audio lessons (approximately 10 minutes each)
  • Offline playback via encrypted browser storage (30-day access)
  • Doodle video generation from lesson scripts
  • Referral program for free lesson credits

3. User Accounts & Authentication

You must sign in with a Google account to use the Service. You are responsible for maintaining the confidentiality of your account. You must be at least 13 years old to use the Service. If you are under 18, you confirm you have parental or guardian consent.

4. Payments & Pricing

Lessons are priced per generation (6 lessons per generation). Prices vary by country:

  • Tanzania: TZS 1,000 per generation via M-Pesa / Tigo Pesa / Airtel
  • Kenya: KES 50 per generation via M-Pesa
  • Uganda: UGX 1,400 per generation via MTN MoMo / Airtel
  • Rwanda: RWF 500 per generation via MTN MoMo / Airtel

Payments are processed through PesaPal. All payments are final and non-refundable. Free lesson credits earned through referrals are non-transferable and have no cash value.

5. Free Generations & Limits

New users receive a limited number of free generations. Once exhausted, payment is required to generate additional lessons. Generation limits are reset at the sole discretion of Makeba.

6. Content Ownership & License

User Content: You retain ownership of the topics you submit. By submitting a topic, you grant Makeba a license to generate, store, and deliver the resulting lessons to you.

Generated Content: Makeba-generated lessons are licensed to you for personal, non-commercial, educational use only. You may not redistribute, resell, or publicly share generated audio lessons.

AI-Generated Nature: Lessons are generated by artificial intelligence and may contain errors or inaccuracies. They should be used as supplementary learning material, not as sole educational sources.

7. Offline Access & Encryption

Downloaded lessons are encrypted (AES-256) and stored in your browser's storage. They are watermarked with your account information. Offline access expires 30 days after generation. You may not attempt to decrypt, extract, or copy the audio files.

8. Referral Program

Referral codes earn free lesson credits when a referred user pays for their first generation. Abuse of the referral system (e.g., self-referrals, fake accounts) will result in forfeiture of credits and possible account suspension.

9. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose
  • Generate content about illegal or harmful topics
  • Attempt to bypass payment or generation limits
  • Reverse-engineer, decompile, or tamper with the Service
  • Create multiple accounts to abuse free trials or referrals
  • Use automated tools (bots, scrapers) to interact with the Service

10. Limitation of Liability

Makeba provides the Service "as is" without warranties of any kind. To the maximum extent permitted by law, Makeba shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Makeba's total liability shall not exceed the amount you paid for the specific lesson giving rise to the claim.

11. Termination

Makeba may suspend or terminate your account at any time for violation of these Terms. Upon termination, your access to generated lessons will be revoked. You may delete your lessons at any time from your Library.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of material changes via email or in-app notice.

13. Governing Law

These Terms shall be governed by the laws of the United Republic of Tanzania. Any disputes shall be resolved in the courts of Dar es Salaam, Tanzania.
